Legislative Decree 196/2003 – Information sheet to the REGISTERED APPLICANT
and consent for processing data

In accordance with international directives on privacy and data processing, we inform you that any personal data that we collect is stored and processed on computer systems registered and used in accordance with applicable legislation. The data may be processed or stored in the United States, in the European Union and in any other country.

The Italian Legislative Decree n. 196 (30 June 2003) guarantees confidentiality of personal data and states that the person to whom said personal data belong (here identified as “REGISTERED APPLICANT”) must receive information concerning the purposes and methods of processing said data, and that he must be asked for his express consent in writing.

The proprietor of the data processing for this information sheet is Calzaturificio Dal Bello s.r.l. (hereafter PROPRIETOR).
Pursuant to the dispositions of art. 13 of the Italian Legislative Decree 196/2003, PROPRIETOR (proprietor of the web site www. freeskierspace.com) hereby communicates to the REGISTERED APPLICANT that the processing of his data shall be subject to the criteria of lawfulness and correctness, in the full protection of the right to confidentiality. Subject to the express consent expressed by the REGISTERED APPLICANT at the foot of this information sheet, said processing shall have the following purposes:
to fulfill the obligations deriving from the relationship to which this information sheet gives consent;
to allow the REGISTERED APPLICANT access to the “reserved services”, including the possibility of inserting comments and participating in forums and discussions therein, of sending photographs, participating in chat rooms, registering on mailing lists, and enjoying any possible future services offered by the site FreeSkierSpace, always within the limits and in observance of the Regulations;
to communicate data to the competent authorities according to law, such as, to give a non-limitative example, for requests for inspection by the tax or judicial Authority;
to inform registered applicants of cultural events and/or activities and/or initiatives organized by the PROPRIETOR and/or by third parties, and commercial/advertising communications and/or sales communications, also concerning services and/or products offered by third parties in any way or form.
to carry out statistical and market research, by defining the REGISTERED APPLICANT’s orientation in the market and/or his commercial preferences.

The data of the REGISTERED APPLICANT is processed with computer-type electronic and automated supports, by means of Servers connected in a network and in any case by means of instruments able to guarantee security and confidentiality, through reserved access using a Username and Password, guaranteeing that there is no interference between processing concerning the various purposes and that access is limited only to those so enabled for each of the purposes inherent to the relationship subsisting between the REGISTERED APPLICANT and the PROPRIETOR.
The networked Servers are kept at Infotrend Development Sas, maintained and managed by Gilberto Mardegan, in closed premises to which only the enabled personnel have exclusive access. The data are transmitted with said Company by means of protected Internet communication and only the collaborators of the PROPRIETOR shall have access thereto, or collaborators who shall be authorized on each occasion.
The REGISTERED APPLICANT shall always have the right to integrate and/or modify and/or update his data, at any time, by means of a written request to the e-mail address: privacy@freeskierspace.com

It is obligatory for the REGISTERED APPLICANT to give his data and express consent for the purposes set forth herein, and therefore any refusal on his part shall bring about the non-execution of the service requested.

The personal data processed shall be exclusively those supplied by the REGISTERED APPLICANT on line.

The following data of REGISTERED APPLICANT, obligatory for registration, shall be retained:
-Username
-E-mail address
-Age
-Country
-Sex

The access data shall also be retained, such as IP address, Host Name and Client type, as well as the data, also statistic, of the visits made inside the site, the comments, the messages written in the Chat area by the REGISTERED APPLICANT.
On our site www.freeskierspace.com only Username, Age, Country and Sex will be published.
On our site www.freeskierspace.com the E-mail address and Access data will NOT be published.
The private messages exchanged between the REGISTERED APPLICANTs remain memorized in the database for the technical time needed to allow them to function, and are subsequently cancelled.

We do not process sensitive or judicial data. Any data transmitted through comments and/or messages by the REGISTERED APPLICANTs concerning themselves or third parties, which might come within the category of sensitive data (pursuant to the Italian Legislative Decree 196/2003) shall be processed exclusively for the purposes of the historical archive, and shall in no way be communicated to third parties. The REGISTERED APPLICANT who communicates such data authorizes publication and assumes all the civil and penal responsibilities thereof which may derive directly or indirectly.

The data in question may be communicated, for all the purposes indicated herein, to third persons responsible for the execution of activities directly connected to and instrumental to the execution of the relationship, and also – subject to consent from the REGISTERED APPLICANT – to third persons and/or Companies, always for the purposes as previously indicated.

The PROPRIETOR of the processing of your personal data is Calzaturificio Dal Bello s.r.l., in the person of the legal representative, with registered offices in Via Frattalunga, 12 – 31010 Casella d’Asolo (TV) – ITALY. The person responsible for the processing – to whom you may refer in order to exercise the rights pursuant to art. 7 of the Legislative Decree 196/2003, hereafter reported – is Calzaturificio Dal Bello s.r.l., in the person of the legal representative, with registered offices in Via Frattalunga, 12 – 31010 Casella d’Asolo (TV) – ITALY, domiciled for the purposes of the present information sheet at the offices of Calzaturificio Dal Bello s.r.l. for the purposes of managing the registered users.

RIGHTS OF THE REGISTERED APPLICANT, pursuant to art. 7 of the Italian Legislative Decree 196/2003:

“1. APPLICANT has the right to obtain confirmation of the existence, or non-existence, of personal data which concern him, even if not yet registered, and to obtain communication thereof in intelligible form.
2. APPLICANT has the right to obtain the indication of:
a) the origin of the personal data;
b) the purposes and methods of processing;
c) the logic applied in the event of processing performed with the aid of electronic instruments;
d) the identification details of the PROPRIETOR, those responsible and the designated representative pursuant to art 5, clause 2;
e) those entities or categories of entities to which the personal data can be communicated or which may acquire knowledge of said data in their capacity as designated representative in the territory of the Italian State, as people responsible or so charged.
3. APPLICANT has the right to obtain:
a) the updating, the correction or, when so desired, the integration of the data;
b) the cancellation, transformation to anonymous form or blockage of the data processed in violation of the law, including those data which do not need to be retained concerning the purposes for which the data were collected or subsequently processed;
c) the declaration that the operations as per letters a) and b) were made known, also concerning the content, to those to whom the data were communicated or broadcast, except for the case where such an action is impossible or entails a use of manifestly disproportionate means with respect to the right protected.
4. APPLICANT has the right to oppose, either totally or partly:
a) for legitimate reasons, the processing of personal data that concern him, even if pertinent to the purpose of the collection;
b) the processing of personal data that concern him for the purposes of sending advertising material or direct sales or for carrying out market research or commercial communication.
With regard to the methods of exercising said rights, please refer to art. 8 (Exercising rights), art. 9 (Methods of exercising said rights) and art. 10 (Confirmation to APPLICANT) of said Legislative Decree 196/2003.”

For each request as per clause 1, where the existence of data concerning him is not confirmed, the REGISTERED APPLICANT may be requested to pay a contribution to the expenses, not more than the costs actually borne. The rights as per clause 1 referring to the personal data concerning deceased persons can be exercised by any person so entitled. In exercising the rights as per clause 1, the REGISTERED APPLICANT can confer, in writing, a power of attorney or proxy to physical persons or to associations.

With reference to the images and movies, including photographs, that are sent by registered users of the site, the staff of FreeSkierSpace accepts no responsibility concerning their content, nor can be held responsible for images that are offensive and/or harmful for the image of third parties. The staff of FreeSkierSpace in any case reserves the right to remove – in the shortest possible time – any images, including photographs, inserted if they are deemed to be offensive, not constructive, scurrilous or for any other reason, in his unappealable opinion and without any prior notice to the registered subject, who, in the unappealable opinion of the staff of FreeSkierSpace, may be cancelled from the community immediately and without any prior notice.

By sending a comment, a photograph or other material, the user grants the non-exclusive use thereof to FreeSkierSpace, who shall be able to use them and publish them in any form and with any means, without making any modifications thereto.

The improper creation of users, with the explicit aim of supporting one’s own comments or of conditioning the community, shall not be tolerated by the staff of FreeSkierSpace. In the event of such behavior, the staff reserves the right to cancel said users and remove the contents inserted by them, without any prior notice and on his unappealable judgment.

The staff also reserves the right to temporarily or permanently block the message board to users considered troublesome following reports and documentation received from other users. In extreme cases the staff also reserves the right to completely forbid access to users who persevere in behavior considered troublesome or harmful to the image of the site itself, and may even cancel them from the site, without any prior notice and on his unappealable judgment.

Moreover, the user is explicitly forbidden to re-sell, lend, give in use or communicate in any way or form his access codes for managing his profile or for inserting comments. In these points the user is the sole person responsible to the staff of FreeSkierSpace.
